These Terms and Conditions ("Terms") govern your use of our website, and your purchase of any course(s), materials, or services (collectively, "Courses") offered on our platform. By purchasing a course or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use our platform or make any purchases.
1. Regulatory Compliance
These Terms are governed by the laws of the Republic of Kenya, including but not limited to:
The Kenya Consumer Protection Act, 2012 (governing fair trading and cancellation rights).
The Data Protection Act, 2019 (governing the collection and processing of personal data).
The Kenya Information and Communications Act (governing electronic transactions and digital contracts).
If you are accessing our platform from outside Kenya, you are responsible for compliance with your local laws, including the GDPR for users in the European Economic Area.
2. Account Registration and Security
Eligibility: You must be at least 18 years old to create an account and purchase Courses. Minors must have a parent or legal guardian open an account on their behalf.
Accuracy of Information: You agree to provide accurate, current, and complete information during registration.
Account Security: You are strictly prohibited from sharing your login credentials with third parties. Epic Academy reserves the right to suspend or terminate your account without a refund if we detect suspicious login activity indicating unauthorized sharing.
3. Intellectual Property and Course Access
Limited License: Upon payment, Epic Academy grants you a limited, non-exclusive, non-transferable license to access and view the Course content for your personal, non-commercial educational use.
Prohibited Actions: You do not acquire ownership rights to the Course. You may NOT:
Download, record, or scrape video content (unless a download button is explicitly provided for offline viewing).
Distribute, copy, sell, or broadcast the Course materials to others.
Modify or create derivative works from our Course content.
Revocation: Any violation of our intellectual property rights will result in immediate termination of your access without a refund and may subject you to legal action.
4. Pricing, Payments, and Taxes
Currency & Taxes: All prices are listed in Kenyan Shillings (KES) or United States Dollars (USD) and are inclusive of Value Added Tax (VAT) and any other applicable taxes under Kenyan law, unless otherwise stated.
Payment Methods: We accept payments via Mobile Money (e.g., M-Pesa), credit/debit cards, and major payment gateways like Pesapal.
Access Activation: Course access is granted immediately upon successful verification of payment. If your payment fails or is subject to a chargeback, your access to the course will be revoked.
5. Refund and Cancellation Policy
Under the Kenya Consumer Protection Act, consumers have the right to clear cancellation terms.
Digital Goods Exemption: Because our Courses are digital products that can be consumed immediately, standard return policies for physical goods do not apply.
Refund Window: We offer a 14-day money-back guarantee, provided that you have not completed more than 10% of the course content or downloaded the proprietary supplementary materials.
How to Request: Refund requests must be sent to info@epicacademy.ke within the stipulated period. Refunds will be processed within the refund window period.
6. Disclaimers and Limitation of Liability
Educational Purposes Only: Our courses are designed for educational purposes. Epic Academy does not guarantee that completing a Course will result in specific outcomes, such as passing official certifications, securing employment, or achieving specific financial results.
Platform Availability: We strive to keep the website active 24/7, but we do not guarantee uninterrupted access. We are not liable for temporary downtimes due to server maintenance or technical glitches.
Limitation of Liability: To the maximum extent permitted by Kenyan law, Epic Academy’s total liability for any claims arising from the purchase of a course shall not exceed the total amount paid by you for that specific Course.
7. Data Privacy
Your privacy is important to us. By purchasing a course, you consent to the collection, use, and processing of your personal data (such as name, email, and payment details) in accordance with the Kenya Data Protection Act, 2019.
We do not sell your personal data to third parties.

8. Amendments to Terms
Epic Academy reserves the right to update or modify these Terms at any time. Any changes will be posted on this page with an updated "Effective Date." Continued use of the platform after changes have been published constitutes your acceptance of the new Terms.
9. Governing Law and Dispute Resolution
Governing Law: These Terms shall be governed by and construed in accordance with the laws of Kenya.
Dispute Resolution: In the event of a dispute, the parties shall first attempt to resolve it amicably through negotiation. If unresolved within 30 days, the dispute shall be referred to mediation, and subsequently to a court of competent jurisdiction in Nairobi, Kenya.
